Data Privacy Framework (DPF)

In July 2023, the EU-U.S. Data Privacy Framework (DPF) was created to replace the invalidated Privacy Shield for enabling legal, secure data transfers from the EU to the US. Privacy Shield was the original mechanism established in an attempt to meet GDPR regulations, but it failed to meet all requirements.

The end goal of these regulations is to protect individuals’ right to privacy, how their personal data is collected, processed, stored, and to give individuals the right to access, amend, and/or request the deletion of their data. Although the GDPR is one of the strictest data protection laws covering the EU, other countries outside the EU have their own versions of data privacy laws, which also must be adhered to.

Per the DPF website, “it is important to note that the EU-U.S. DPF is not a GDPR compliance mechanism, but rather is a mechanism that enables participating organizations to meet the EU requirements for transferring personal data to third countries.”

Marden-Kane’s core focus is the administration and management of sweepstakes, contests, and instant win game promotions both domestically and internationally. We understand the need to protect and secure client data and have done so for over 65 years. That is why it is extremely important to us that we achieved compliance with the DPF Program once it was made available. As part of the requirements, Marden-Kane has self-certified, which you can review in our Privacy Policy.

As a reminder from our previous GDPR article, what you need to know is this:

Marden-Kane has already made a commitment to our clients and to those individuals from whom we collect data on their behalf. We work hard to ensure that an individual’s personally identifying information (PII) is kept private, and that we meet all legal and compliance specifications when it comes to your data.

Additionally, we have developed a form that will allow you and your customers to make requests related to removing any personal data that might have been processed by us in relation to a contest or sweepstakes, regardless of being a member of the EU or not.
