How to Obtain a Sweepstakes Waiver in Florida

Certain sweepstakes or games of chance may need to be registered and bonded in certain states, such as, Florida, New York and Rhode Island (registration only) if the promotion meets the legal requirements.

There is an additional component to the registration/bonding process for the state of Florida, which is referred to as a Waiver.

According to Florida law, any Sponsor or Operator that has conducted games of chance promotions in the state of Florida for not less than five (5) consecutive years, and has not had any civil, criminal or administrative action instituted against the Sponsor or Operator by the state of Florida or any agency of the state for any violation within the five-year period may be entitled to a Waiver. A Waiver is a document that allows a Sponsor or Operator to register a promotion without a bond and/or trust account. The Waiver is very easy to complete and is typically completed by the Sponsor or Operator.

We can file Waivers on behalf of our clients if they wish for us to do so. All that is needed is a properly signed and notarized Affidavit from the client granting the necessary permissions to Marden-Kane.

It is important to know that once a Waiver is earned it can be revoked at any time should a violation arise. And, even if a Sponsor or Operator receives a bond waiver, they still need to register the promotion within the time frame constraints set by the state of Florida.
